1.Introduction
Welcome to Tendy ("we", "our", "us"). Our platform connects hockey skaters ("Skaters") and hockey goalies ("Goalies") to facilitate the organization and payment of hockey games. By using our platform, you agree to these terms and conditions, which apply to all users, including Skaters and Goalies.

2. User Responsibilities
Users are responsible for providing accurate, truthful, and complete information during registration and for maintaining the confidentiality of their login credentials. Skaters agree to post accurate game details and honor payment commitments. Goalies agree to accept games and check in using the code provided by Skaters. Users must ensure compliance with all applicable local, state, and federal laws while using our platform.
Users and Goalies will be charged our booking fee if they cancel after a match is made. If either party does not check in or contact us, they will be charged the full amount. Skaters will be charged the goalie fee and booking fee, and Goalies will be charged the booking fee. Users have three (3) days to contact us to correct the charges, and we will investigate the issue. Extenuating circumstances, such as injury, illness, or game cancellations, must be reported to us and are subject to our review and determination.
Skaters also have the option to promote a game for an additional fee, which will bring the game to the top of the list of available games and label it as a priority.
Users can report bugs or ask questions through the "Contact" button available in each order or in the app settings. While there is no SLA for fixes, we actively test and implement new features and fixes.

3. Account Registration
To use our platform, users must create an account, providing accurate and complete information. Users are responsible for maintaining the confidentiality of their account information and for ensuring it remains up to date. Misrepresentation or misuse of the platform may result in account suspension or termination.

4. Payment Terms
Skaters can pay Goalies through Stripe or arrange payments offline. Skaters also pay a fee to us. Goalies can choose to receive payments through Stripe or offline. We will attempt to reconcile payment disputes but make no guarantee of resolution. We are not responsible for payment disputes arising from offline transactions or delays caused by third-party payment processors.

5. Game Posting and Acceptance
Skaters post games and set payments for Goalies. Goalies accept games through the platform and check in with a code provided by Skaters upon arrival at the game. Users are solely responsible for ensuring the accuracy of posted game details and honoring game commitments.
Game cancellations or incomplete transactions are at our discretion to determine a conclusion. While we will attempt to reconcile disputes, we make no guarantee of resolution. Otherwise, applicable fees will apply.
We do not guarantee a goalie will be found, but we notify every available goalie signed up for Tendy and selected that rink.

6. Data Storage and Privacy
We use Google Firebase to store user information, including your name, phone number, entered zip code, player role, and information on games played. By using our platform, you consent to the storage and processing of your information on Google Firebase. Tendy does not store user information directly. None of the user's information is held with our company. Stripe may store payment information as a default payment type if users choose to use Stripe for transactions. Our use of your data is governed by our Privacy Policy.

7. Liability Disclaimer
We are not liable for disputes or issues that arise between users, including but not limited to payment problems, missed game commitments, and game-related injuries. Users agree to resolve such disputes independently. Users agree that participation in hockey games involves inherent risks and that Tendy is not responsible for any injuries or damages resulting from participation.

8. Third-Party Services
We use Stripe to facilitate payments and Google Firebase to store data. Users must comply with the terms of service of these third-party providers and are responsible for any issues arising from using these services. Tendy disclaims all liability for disputes or damages caused by third-party service providers.

9. Termination and Suspension
We reserve the right to terminate or suspend any user's account at our discretion, including for violations of these terms and conditions or any other harmful behavior. Suspended or terminated users are prohibited from re-registering without our explicit approval.
While we do not currently have an automated suspension system for frequent cancellations or reported issues, this feature will be implemented in the future. Suspension decisions are currently made at our discretion.

10. Dispute Resolution
In the event of a dispute between users, we encourage resolution through mutual agreement. If a resolution cannot be reached, users may contact us for assistance; however, we do not guarantee resolution or mediation outcomes. Users agree that Tendy’s role is limited to facilitating connections and payments.
We may encourage users to consider alternative dispute resolution methods (such as arbitration) for unresolved disputes.

11. Indemnification
Users agree to indemnify and hold us harmless from any claims, damages, or expenses arising from their use of the platform, including breaches of these terms, legal violations, and disputes between users.

12. Governing Law
These terms and conditions are governed by the laws of The United States of America. Any legal actions related to these terms will be brought in the courts located in The United States of America.

13. Eligibility
Users must be at least 18 years old to register for and use our platform. By creating an account, you represent and warrant that you are at least 18 years of age.

14. Copyright and Trademarks
All rights, title, and interest in and to the Software, including but not limited to the design, functionality, content, trademarks, trade names, logos, and other likenesses (collectively, "Tendy Intellectual Property"), are owned by Tendy LLC or its licensors.

• You are prohibited from copying, reproducing, modifying, distributing, displaying, or using any of the Tendy Intellectual Property without explicit prior written permission.

• Any unauthorized use of Tendy's logo, name, or likeness for commercial purposes, derivative works, or in any manner that may mislead or confuse users is strictly prohibited and constitutes a violation of this Agreement and applicable intellectual property laws.
